Visa refusals – Can they happen with Down Under Visa?

Down Under Visa are Registered Migration Agents. The Migration Agents Registration Authority (MARA) is run by the Department of Immigration and Border Protection, and we operate by Law under a Code of Conduct. That Code prevents us promising any particular outcomes, ie. from guaranteeing a visa grant. Not possible, because we are not the ones who make the final decision.

What we do is to prepare the application professionally, ensuring that we do everything we can to address the criteria for that Australian visa written in the Migration Regulations. This is why we push you all so hard sometimes, because we know what they want to see and in most cases we are able to do just that.

And then we lodge the visa applications, and we wait and see.

Why can’t we guarantee an outcome? Because we are not the ones who make the decisions. And some of the Regulations are extremely subjective.

There are Regulations like this: [600.211] The applicant genuinely intends to stay temporarily in Australia for the purpose for which the visa is granted

How do we prove that beyond reasonable doubt? Not something where we can guarantee that the Case Officer in the Australian Embassy in Manila will agree with us. How can anyone absolutely prove “genuine intent”? Therefore we provide no guaranteed outcomes, because we can’t.

However…….

We get very few visa refusals, we’re happy to say. Yes, of course they happen. And we have to maintain our usual extremely high standards. We won’t take on cases where we believe there will be a refusal. And in cases where we think the chances of success are low, we will tell you that also. I told somebody just yesterday that the chances of success at bringing younger-sister to Australia for a visit were low. He wasn’t happy about it, but sorry….I won’t lie about poor chances. When we do take on cases, we will go all out to bring about a positive result.

But despite this, we do still get some refusals.

In many cases we’ve gone and redone the application for free of our professional fees, especially when we feel that the decision was a bit harsh. And every time we’ve done that, the visa has subsequently been granted.

And again….it doesn’t happen very often, so when Down Under Visa take you on as a client you know and your visa application are in very safe hands.

Can you please tell me what i can do to stop a woman coming here from the philippines,?i told immigration that i do not want to marry her and i have made it clear to her and her family in brisbane that i do not want anything to do with her or her family.I am even thinking of going to court so that the police and immigration know that i am serious and the police told me that if i did that she would not be able to come near me,i told them that is find because i have had enough and as far as i am concerned it has been over for a long time

If she's got a partner visa, you just need to let the Australian Embassy in Manila know that you've withdrawn your sponsorship. Without sponsorship, there is no basis for her having that visa. I can't guarantee what they will do, but normally they will cancel the visa.

I just want to ask because my f applied last april for me as tourist visa but is refuse he lodge online I want to know why it happends..and we plan to apply visa again can you let me know what are the best things to do..is it esier to apply in manila or here in hongkong thank you hope to hear from you soon
