She wasn’t married to the father of the child. Can we get him a Child Visa?

Under Philippines Law, children born out of wedlock are the sole responsibility of the mother. An unmarried biological father has no say in what happens to his children.

What’s better? A Child Visa, or adding the child to a Partner Visa?
Her son has a biological father she was married to. Can we get him a Child Visa?

      If they feel you are using tourist visas in place of a partner visa, yes they will say ENOUGH. Do you have any compelling and compassionate circumstances which could make up a waiver application?

    Hello! Greetings of Peace and Joy!

    I was married to an Australian citizen (he is naturalized citizen) last 2016. We were married in Sydney, I was already 4mos pregnant. I went there as a tourist. After 2 years of good relationship. He disappeared. I emailed him, reached out for him but to no avail. My concern is my son. How can i get him or apply him to get an Australian citizen by descent. My info with my husband is just a copy of his passport, and our marriage doc. Please help me!
    Thanks;
    Anne

      You can apply for his Citizenship if you can prove that his biological father is Australian. You don’t require his father’s sponsorship. Success will depend on you having sufficient evidence.
