Can we apply for a visitor visa and then an onshore partner visa inside Australia for an Australian Filipina couple

In this week’s episode of our Weekly Q&A one participant asked Can we apply for visitor visa then onshore partner visa?

The exact question was:

Can you apply for a visitor visa (tourist visa) in the Philippines with the intention of going to Australia and applying for an onshore partner visa? Is this legitimate grounds for a visitor visa?

Once upon a time it was impossible to do this, because practically all tourist visas from Philippines to Australia had “No Further Stay” Conditions on them, which prevented further applications inside Australia. This is very unusual these days, and most are able to apply for further visas inside Australia, including partner visas. Is it OK to apply for a visitor visa and them apply for a partner visa once you arrive?     I am a bit confused. Applying for a onshore partner visa while on a tourist visa does that means it is a bad thing and you have more chance of being rejected because of that if you apply for the same thing after she returns home to then apply off-shore?

      Didn’t quite get the last part of your question, Robert.

      First part: Probably 1/2 of our partner visa clients are applying this way. Not a bad thing. And as long as you’re completely prepared, then no more chance of refusal.

    My partner and I wanted to apply a de facto or partner visa but I an only a toriest visa holder which until 20th of February this year. Please advise us and list of requirement.

      1. You can’t prepare and lodge a partner visa in such a short time. You will mess it up if you try.
      2. There is no “standard list” of requirements that I can give you. It changes depending on the circumstances of the client’s situation.

      I would suggest you either return to the Philippines, or look at a new tourist visa at this stage. You don’t have enough time to prepare and lodge a good partner visa application.
