We at Down Under Visa often get prospective clients contacting us via our free assessment form who:

(a)    Tell us that their lady is pregnant, and;

(b)   Clearly hope that we can either speed up an Australian partner visa application, or find another visa option that’s quicker.

Sadly we can’t speed things up. There is no possibility of expediting an application through the system because the applicant is pregnant. The fact is it’s NOT the most uncommon thing. It’s remarkably common. Being in love, and making babies? They seem to go together! I wouldn’t mind a dollar for every pregnant visa applicant we’ve had over the years.

So what can you do?

Other visa options?

You really only have one visa option if the applicant is already pregnant.

 

Partner Visas

That option obviously is one of the partner visa options, ie.

  • Prospective Marriage Visa (aka fiancée visa) if you plan to bring her to Australia as your fiancée and marry her there
  • Partner Visa (aka spouse visa) if you plan on marrying first

These are both offshore visas, and they are designed to bring fiancées, husbands and wives, and de facto partners together. We prepare the application and lodge offshore in Manila, and she waits for the visa to be granted.

Now, obviously this means giving birth NOT in Australia. Not ideal, but you need to face facts. They will NOT push your application to the head of the queue and push somebody else back in the line. It’s just the way it is.

So given this reality, start getting prepared for her giving birth in Philippines, China, Thailand or Vietnam. Not the end of the world. There are about 100 million Filipinos all born in the Philippines and a whole lot more Chinese in China, so it’s obviously not that bad. Be aware that medical care varies here from world-class right down to third-world. Don’t assume that it’s the same as Australia. Be prepared to spend enough to get the best possible treatment, and it will be a load off your mind. And you’ll find it not as expensive as you would expect.

 

Other visas?

Australian Visas are designed to fit certain scenarios, and are not known for their flexibility. Their criteria is set out in the Migration Regulations. Meet the Regulations, and you get a visa. Don’t meet them, and they are required to refuse the visa.

So trying to squeeze another visa into a shape that fits what you want to do? It will be doomed to failure. Try to pretend that the lady really wants to study hairdressing in Australia in order to get a student visa? They will see right through this. Trying to get a speedy tourist visa so she can stay, give birth and then get to remain in Australia? That won’t work either.

Best advice is that if you haven’t started preparation for an Australian Partner Visa yet, that you get on with it. Don’t put it off. The sooner we start, the sooner she (AND your new baby) will be there in Australia with you.

    Hi jeff, how about if the lady with tourist visa has already enter australia & she is pregnant now? we booked to get married next month at NSW Birth Married Death department? What kind of visa should she apply? how to get the medicare card?

      Hello Carindra. You may apply for a partner visa based on the marriage, provided there is no restriction (ie. Condition 8503, which you can read about on our BLOG….just search “8503”) on applying for further visas.

      Once you’ve paid the visa fee and have a receipt and acknowledgment of the application being lodged, you may apply for a Medicare card at the Medicare office.

      But there is a LOT of work involved in preparing a good partner visa application which will be granted. If you would like help, suggest that you complete the online Visa Assessment Form on our website.

        Hey Jeff.
        My Filipina partner and I have been together for 5 months.. I have recently been to visit her, spending 9 days with her and meeting her family members and staying at her home. We are looking at getting a tourist visa for later this year (approx 3-4 months) or whenever is possible this year. She has been told that she needs up to 100,000 peso in savings just to get a visa.. Is this true or is it false. We are also looking at getting a partner visa in the new year. We are pretty definite on our intentions. We both have children of own which she obviously wants to have her 2 youngest here with us. (they are 13 and 7). My kids are 9,10 and 12. I am 51 and she is 45. I have my own home and she will be staying with me. We have an extensive relationship history back to February this year. Any other information would be a great help.. We have downloaded the ebook and the question of these savings is one thing we have still have doubt about.. Thank you.

Most of our applicants don't have savings, and it's never been an issue. Ask her to stop getting advice from friends. Suggest that you get a free online visa assessment form filled out. Top right of this page, or the blue rectangle at the bottom of the article. It will take you five minutes. Then I can advise you properly.

            Hi sir, my girlfriend is 6 months pregnant. i am planning to get a tourist visa when the month of her giving birth will come. may i ask if i can stay in australia after she gave birth? since im the father of child. im planning to take tourist visa for 3 months and what are the requirements? thanks

            Firstly, no she can’t remain in Australia just because she has a child with you.
            Secondly, she won’t get on a plane close to the time of birth. The airlines don’t want the risk of someone giving birth in the plane.
            Thirdly, the child would obtain Australian Citizenship IF baby was born in Australia. The mother will not.
            Fourthly, when the tourist visa runs out the mother will have to leave Australia, and the baby remain in Australia.

            I think you can get that what I’m saying is that you need some guidance or you will face a disaster! Get an assessment here on the page!

        A bridging visa is a bridge between (a) an expired visa and (b) a new visa you’ve applied for. What bridging visa are you holding now, and how did you get it?

      I am enrolled to a higher degree by research as an international student with university scholarship and all the expense covered (including OSHC). I am about to apply for student VISA with my 5 month pregnant wife. I was worried if this could affect my VISA outcome. I don’t want to miss this big opportunity and my wife is suggesting me to apply my VISA alone and apply for her after she gives birth. Please direct me to the better option.

      You can’t push a visa through, sorry. And being pregnant is not so exceptional with partner visas. You probably don’t have very long to wait. Just be patient.

    How you doing? I am a permanent resident of Australia. Its been a year that I have applied for my wife’s partner visa 309 and brought her here on tourist visa. Now Case officer mailed us to seek an appointment for the medical. But my wife is pregnant and i am quite aware of the fact that the visa will be postponed as she will not be able to get all her medical done in this situation. In such a case, can I request for extension of tourist visa. Can she give birth in Australia and stay with me and then request to progress for my partner visa after birth of baby. Please suggest me.

    I am a filipina and my husband is Australian and I am Pregnant now with 4 months and we are planning that I am going to deliver this baby in Australia and we are going to use Australian Visa, We know that he can’t use medicare card so he will just pay the hospital bill how much it will cost. My question is it okay to use visitor visa just to deliver the baby there and then go back here in the Philippines. After I go back here we are going to process the partner visa. What is the best thing to do?

          You can apply for a partner visa inside Australia if you are legally married, and provided the tourist visa doesn’t have a Condition 8503 on it. If she has applied for a partner visa, she can apply for Medicare which will cover the costs. If not and you need to pay for it? Could be around AUD$15,000.00 or more.

    so I’ve met a girl online from the philippines we’ve been talking for weeks and now we’re planning to meet each other. I am 31 and she’s 20 and she’s planned to come to Sydney around the 26th Feb 2016. She’d be on a tourist visa and staying with me for the duration. There are no guarantees but we would both like to assume that we’d be passionately involved with each other during this time and would like to take steps to have her living here permanently. We want to do it right but also do it so we don’t have to be apart.

    This three months is to show her around Sydney and spend quality time with each other and decide if we are going to be more than just cyber love. So it’s most likely that we will be committed to each other so what do we need to do and to do it right?

        Good evening. Hope you are well! I’m a filipina in Sydney currently on bridging visa (awaiting my partner visa). I’m pregnant and will give birth February 2020. I just received my Medicare but my Aussie partner said even if I gave birth in public hospital here in Sydney it’s not covered by Medicare, is that true?
        I’m a very frugal (kuripot!) filipina and the idea of spending atleast $15,000 to give birth here is driving me nuts.
        Should I move back to Manila to give birth? Or just hope and pray Medicare will cover my childbirth?

    my question is. I have met a girl online in ghana (i know you deal in the filliphines) but im sure visa’s would be the same for most people. We have been chatting online for two weeks now, she is starting studies in Ghana for the next three month to improve her chances of working in Australia. I have read many of your answers. My question is. With online dating how do you prove that you have been in a legit relationship to the immigration department?
    We were thinking she comes out here on a work visa, then we apply for a permanent visa (not sure which one to apply for yet? Ghana is not a cheap place to fly to and I haven’t met here in person yet? I am still married until mid November. So i would need to wait for that to finalise before I could sponsor her?
    Like everyone else I would like to better our chances of getting her to live with me here. any advice would help. thanks

      Basic nuts and bolts here?

      1. Two weeks and you’re talking marriage? And to somebody you haven’t met in person? If it was you doing the assessing, would YOU approve such an application? Visas are grants, and not rights. They have a job to see that only genuine applicants get visas, so your job is to prove that this is a genuine application. You can’t prove that after two weeks of online chatting. Let the relationship mature, and go meet her in person. Meeting in person is a sign of commitment. If you are not committed enough to fly to Ghana, why would they grant a visa?

      2. Work visas are for people who have significant skills, ie. professions or trades that are needed in Australia, AND where the applicant has a job offer from a qualified Australian employer who will pay her a high salary. If she doesn’t have those, she won’t get a work visa. And work visas are not a way for couples to be together. Even if she had those skills, if they thought you were using it to get together they would refuse it.

      Go meet her. Let your relationship mature. After at least four months, you would have a chance at a tourist visa or even a partner visa.

    I’m not Filipina but yours was the only website where I found information about traveling to Australia while pregnant, so I’d like a consultation if possible. I’m married to an Australian citizen, we have been living abroad until now. We were considering for applying for partner visa, but not in a hurry until I discovered that I’m pregnant. I already have a valid eVisitor visa (for tourism purpose, multiple entry, I used it once, staying for 10 days to visit family) and it does NOT have the “No further stay” condition, so the plan was to come to Australia on it and apply on-shore, so that my husband’s family can help after the birth. The trouble is: I will be heavily pregnant when traveling. Is it possible they turn me back? I’m planning to fly in my 7th month of pregnancy, apply for partner visa as soon as I get there (for which I need a migration lawyer), give birth, get a bridging visa until the partner visa is decided. None of these can be put in motion if they don’t allow me to enter Australia on a visitor visa while pregnant. Can you please advise? Thank you so much.

      It’s not an immigration issue, Carmen. You need to contact the airlines to see if they will let you fly. The obviously don’t want you going into labour whilst in the middle of the ocean. Need to discuss with your doctor also.

    Hi,
    I am waiting for 309 visa for my wife. application lodged on 5 march 2017.
    all PCC and medicals done.

    wife is pregnant due in march 2018.
    what is she didn’t get visa until Jan 15? we will have to get the delivery in India.
    Since I am citizen, I understand baby will be citizen,
    But to get baby here assuming visa is not granted, do I need to add baby along with wife’s application?

    please advise.

We got the visa on 4/5/2017 and then she travelled to Australia on 24/10/2017 … if my wife is pregnant and expecting baby during March -may 2019 , is she eligible to continue to stay in Australia until she give birth to baby ?       Of course she can stay. She can get a Medicare card too. Are you an Australian Citizen? If so, the child will be born as an Australian Citizen. Just let Immigration know the details of the birth, and include updates when she does the 100 visa.

    I am working with a 37 YO Japanese lady who came to Australia on a student visa, during this time she met her current boyfriend 3 years ago. Long story short during her placement she experienced a significant workplace injury so is now on a medical visa.
    Both her partner and her would like to try for a baby…..can you advise the best option for her.

    Hi,
    I’m an AU PR currently & my travel facility is expiring on 01/Jan/2019. I live with my wife in the UK currently & she is 8 weeks pregnant.

    After I got my PR in Jan/2014, I went to Oz in Feb/2014 to make my initial landing. Bu thenafter, I couldn’t go there mainly due to my work commitments & then I got married in Jan/2016.

    Can I apply for a 1 year RRV, will I get it considering my situation ?

      Firstly, I think you are talking about a skilled visa which is not our area. And your situation sounds complicated. Suggest you find a Registered Migration Agent and get some proper advice.

      Congratulations on the good news. Unfortunately though there is nothing you can do to speed up the process, sorry. Getting pregnant is not exceptional or unusual, so they won’t give any special treatment. You can only hope it’s granted before.

      Ages! Why not get a tourist visa for him so he can at least spend a few months with you? You can even do that after lodging a partner visa.

    Hi there,
    My fiance arrived on Prospective Marriage Visa in Sep 2019 and we got married on Dec 2019.
    We have now applied for stage 1 820 visa, but do we need to notify immigration about her being pregnant as change in circumstances ?
    She still have valid visa and her bridging visa A will come into effect in June 2020 when Prospective Marriage Visa Ceases.

    Hello,
    I’m in BVA (tourist visa) I am living now with my partner Australian citizen . The immigration asked me to have medical, which is I had already before I arrived here, and we rang bupa and said I have to wait for 14weeks to have medical because I am 3weeks pregnant. We already notified the immigration by attaching the cover letter.
    I wonder if it will affect on my application, because the refferal letter will runs out soon.
    Should we withdraw the application, or wait 14 weeks to complete medical or apply partner visa before giving birth? Thank you in advance.

So I have a question that hasn’t been answered by given agencies I’ve called but anyways I’m Australian citizen but I’m pregnant now and my partner is a temporary visa holder so my question is can I sponsor him since we’re starting our little family or there’s a process since marriage and defacto is out of the question?
