Condition 8503!
UPDATE: This information in 2016 is outdated. Condition 8503’s from Manila are extremely rare these days. We haven’t seen an 8503 in about 2 1/2 years. Please feel free to discuss if you have concerns.
Practically every Subclass 600 Tourist Visa to Australia from Philippines will have this condition on it. If you don’t believe me, look at your visa grant letter. In the days of visa stickers (and when the visa was called a Subclass 676 Tourist Visa), it would be displayed on the sticker itself. Nowadays with visa grant letters, you will see:
Conditions:
8101 – NO WORK
8201 – STUDY LIMITATION
8503 – NO FURTHER STAY
The last item is what we’re talking about. 8503 – NO FURTHER STAY
What this means is that the applicant cannot apply for another visa while she’s in Australia. If she wants another visa, she must leave the country first.
And let me make this crystal clear. There is no such thing as “an extension” to a tourist visa. To stay longer means getting another visa, ie. a brand new tourist visa application. And if there’s a Condition 8503 limitation on the visa, then you cannot apply for another tourist visa inside Australia. The applicant must leave the country and apply again. She cannot stay.
What this means is that if you had any thoughts of bypassing the long wait and applying for a PARTNER VISA in Australia, it won’t work! This is why the Condition 8503 is applied in the first place, ie. to avoid “queue jumpers”. DIAC has an intense dislike of people playing the system and trying to use visas for purposes other than what they were designed for, and this is why they put this Condition 8503 on visas grants from countries like Philippines. So if this was your plan, think again!
Are there any exceptions? Can the Condition 8503 be waived?
Yes, in some circumstances where you have compelling and compassionate circumstances we may apply for a waiver. And no, you cannot request a visa WITHOUT a Condition 8503.

Your blogs are really so awesome! Me and my husband finds it very interesting and has been feeding us for quite some time now.
We just recently got married and he loves my city and was thinking of living here and do some business however he is quite unsure yet because he have children in Aus and i have mine here too.
He is now back to Aus and i saw it is really difficult to be apart so i would like to know if it is possible to visit him even if he haven’t found any job yet and i am self-employed managing a little sari-sari store in my hometown. It won’t be easy to leave the business because my parents are always busy with their own jobs but i had already spoke with my mother for her to manage the store while i will be away.
Would you think our situation is complex and will require a waiver from you?
I had actually emailed you yesterday but i found this page interesting to leave a comment since i am only mainly to visit my husband.
Please advice.

For a westerner to try to earn a living in the Philippines is not so easy, and most business plans fail miserably. And if he has no job and I imagine not much money, he’s definitely not in a position to support himself here whilst seeing if a new business is successful or not.

Hi jeff, i came to australia on 600 visa i got no further stay on it. I got admission here at qut brisbane but my classes starts in 20 days now i dont have enough time to go back and apply for a new visa that would take alot of time i might have to skip semester. Should i apply for waiver of no further stay is this a good reason?? what are my chances??. Also i mentioned in my visa that i will be looking for uni for myself. Please help me i am stressed what should i do.

Of course it’s true.
Note that I’m talking about the tourist stream. The family sponsored stream has Condition 8503’s on all of them. And note that this is not a guarantee that they won’t put an 8503 on an application that you lodge yourselves. We’re only speaking from our own experience.
So I have a 7 year old step child and hoping that she will be coming to Australia, her mum has doesn’t have “no further stay ” on her visa. But now I am a bit worried that my step child might have the “no further stay ” on her visa. is it possible to waiver her visa by any chance
You can’t ask them not to include an 8503, sorry. You can apply for a waiver if you have exceptional circumstances that are compelling and compassionate. If the circumstances are not, then this will not be successful.
